The 7.5% figure you found is not your rate

Search for stamp duty in Madhya Pradesh and almost everything you find quotes 7.5% stamp duty plus 3% registration. Those are among the highest property rates in India, and people renting a flat understandably panic.

That rate is for buying property, not renting it

7.5% and 3% apply to a sale deed — a conveyance transferring ownership, calculated on the circle rate or transaction value. A rent agreement is a completely different instrument under a completely different article. On an eleven-month tenancy in MP you pay ₹500, whatever your rent is.

It is worth being clear about this because the confusion runs both ways. Some tenants overpay out of caution. Others assume the whole thing is trivial and execute a two-year lease on a ₹500 paper, which is a different and more serious problem.

The eleven-month rule

Where the twelve-month line changes everything

Section 17(1)(d) of the Registration Act, 1908 makes registration compulsory for leases from year to year, or for any term exceeding one year. In Madhya Pradesh crossing that line does two things at once: it triggers registration, and it switches stamp duty from a flat fee to a percentage calculation.

11 months or less
₹500
  • Flat, regardless of rent or deposit
  • No Sub-Registrar appointment
  • No registration fee
  • Valid and enforceable if properly stamped
12 months or more
Percentage
  • Duty on average annual rent plus deposit
  • Rate steps up with the length of the lease
  • Registration fee applies on top
  • If unregistered: inadmissible as evidence (s.49)
We calculate the longer-lease figure before you pay

Madhya Pradesh computes duty on the SAMPADA portal against the specific rent, deposit and tenure of your agreement, and the rate band depends on how long the lease runs. Rather than quote you a percentage that may not match your case, we run the calculation for your agreement and tell you the exact amount before anything is paid.

What makes MP different

Your deposit counts. In most states it does not.

This is the detail that catches people out on a longer MP lease. Once you pass eleven months, stamp duty is charged on the average annual rent together with the security amount — the deposit is added to the base, not ignored.

StateHow the refundable deposit is treated
Madhya PradeshAdded to the base
Tamil NaduAdded to the base
MaharashtraNotional interest on the deposit added
DelhiIgnored — a flat ₹100 instead
Andhra PradeshIgnored — duty on rent alone

So a landlord in Indore asking for three months' deposit on a two-year lease is quietly increasing the stamp duty on that agreement. It is worth knowing before you negotiate the deposit, not after.

Which law governs you

The Accommodation Control Act, 1961

Madhya Pradesh tenancies sit under the M.P. Accommodation Control Act, 1961 — one of the older tenancy statutes still in force anywhere in India. It uses the word "accommodation" rather than "premises", defining it as a building or part of a building used for human habitation, and it sets out the specific grounds on which a landlord may seek eviction.

M.P. Accommodation Control Act, 1961

Defines accommodation and tenant, fixes the grounds for eviction, and provides the mechanism for determining fair rent. It carries a number of exceptions and qualifications, so whether it reaches your tenancy is worth checking.

Registration Act, 1908

Section 17(1)(d) sets the twelve-month line. Section 49 bars an unregistered lease that required registration from being used as evidence of the tenancy.

Model Tenancy Act, 2021

A central model law only. Tenancy is a State subject and Madhya Pradesh has not replaced the 1961 Act with its own version, so the older statute continues to govern.

Notarisation is not registration

A notarised agreement is not a registered one. Notarisation adds authenticity and costs little, and we recommend it — but it does not satisfy Section 17 where a lease runs twelve months or more. Notarised vs registered, explained.

How it works

Four steps, no office visit

Madhya Pradesh runs stamp duty and registration through SAMPADA 2.0, the state portal operated by the Inspector General of Registration. It handles duty calculation, online payment and e-stamp certificate generation.

Six clauses that decide the dispute

Deposit and refund window

Name the refund days and the permitted deductions. On a lease beyond eleven months the figure also feeds your stamp duty base.

Renewal and escalation

Most MP tenancies renew at eleven months. Fix the escalation percentage upfront rather than renegotiating each year.

Notice period

State it explicitly and state it both ways. Custom is not a clause you can rely on.

Maintenance split

Structural repairs versus day-to-day upkeep, plus who pays for water and electricity connections.

Purpose of use

Residential or commercial. Indore and Bhopal have substantial commercial letting where this changes what protections apply.

Property description

Full address with colony, ward and plot or khasra number. Precision prevents identification disputes later.

What you need

Four documents

  • Aadhaar — landlord and tenant
  • PAN — both parties
  • Property address and ownership reference
  • Signatures of both parties and two witnesses
Separate obligation

Tenant verification

Madhya Pradesh Police runs tenant verification, and Indore and Bhopal push it actively given the volume of student and working-professional tenancy.

It is not completed by executing the agreement, and the obligation sits with the landlord.

Avoid these

Five expensive mistakes

  • Applying the 7.5% sale-deed rate to a rent agreement. Completely different instrument. An eleven-month tenancy is ₹500.
  • Executing a two-year lease on a ₹500 paper. Beyond eleven months the calculation changes and ₹500 will not cover it.
  • Forgetting the deposit on a longer lease. MP adds the security amount to the base. Leaving it out under-stamps the document.
  • Treating notarisation as registration. Two different things, and only one satisfies Section 17.
  • A vague deposit clause. See our drafting do's and don'ts.

Questions

Frequently asked

What is the stamp duty on an 11-month rent agreement in Madhya Pradesh?

A flat ₹500, regardless of the rent or the deposit. It is one of the more predictable short-tenancy rates in the country, and it does not change with the size of your rent.

Does the 7.5% stamp duty rate apply to my rent agreement?

No. The 7.5% stamp duty and 3% registration fee apply to a sale deed — a conveyance transferring ownership of property. A rent agreement is a different instrument entirely and attracts ₹500 on an eleven-month tenancy.

Does an 11-month rent agreement need registration in Madhya Pradesh?

No. Section 17(1)(d) of the Registration Act, 1908 makes registration compulsory only for leases exceeding one year, which is why the eleven-month term is standard across the state.

Is the security deposit included in the stamp duty calculation?

On an eleven-month agreement it makes no difference, because the duty is a flat ₹500. On a lease beyond eleven months, yes — Madhya Pradesh charges duty on the average annual rent together with the security amount.

Which law governs tenancies in Madhya Pradesh?

The M.P. Accommodation Control Act, 1961. It defines accommodation and tenant, sets the grounds on which a landlord may seek eviction, and provides a mechanism for fair rent. It carries several exceptions, so whether it reaches a particular tenancy is worth checking.

Who pays the stamp duty and registration charges?

No statute allocates it. In MP practice the tenant usually bears it, but the parties are free to split it — just record the arrangement in the agreement so it isn't argued later.
