What makes AP different

A percentage, not a flat fee

Most guides you'll read online are written for Delhi, where an 11-month agreement costs a flat ₹100 no matter what the rent is. Andhra Pradesh does not work that way. Stamp duty here is charged as a percentage of the total rent payable across the whole lease term, under Article 31 of the Indian Stamp Act, 1899 as applicable to the state.

Lease durationStamp duty
Up to 10 years0.4% of total rent payable
10 to 20 years0.6% of total rent payable
20 to 30 years0.8% of total rent payable
30 years and above5% of total rent payable
Registration fee, where registration applies0.1% of total rent
The security deposit does not count

AP calculates duty on rent alone — the refundable deposit stays out of the sum. That's a meaningful difference from Karnataka, where the deposit is added to the base and Bengaluru's ten-month deposits push the figure up sharply.

The eleven-month rule

Eleven months vs twelve, on the same flat

Section 17(1)(d) of the Registration Act, 1908 makes registration compulsory for leases from year to year, or for any term exceeding one year. In Andhra Pradesh the money gap between the two is modest — it is the process that costs you.

11 months
₹660
  • 0.4% on ₹1,65,000 total rent
  • No Sub-Registrar appointment
  • Neither party has to travel
  • Fully valid and enforceable
2 years
₹1,800
  • 0.4% on ₹3,60,000 total rent
  • Plus 0.1% registration fee
  • Both parties must attend the Sub-Registrar
  • If unregistered: inadmissible as evidence

Based on a 2BHK in Vijayawada at ₹15,000/month with a ₹60,000 refundable deposit.

Do not under-stamp

Under Section 35 of the Indian Stamp Act an insufficiently stamped instrument is inadmissible as evidence, and Section 40 lets the Collector impound it and levy a penalty of up to ten times the deficient duty. Unsure which value applies? See which stamp paper you need.

Which law governs you

The 1960 Act, and where it stops

Tenancies in Andhra Pradesh sit under the Andhra Pradesh Buildings (Lease, Rent and Eviction) Control Act, 1960, which covers rent fixation, the grounds on which a landlord may seek eviction, and a tenant's protections. It applies to notified areas rather than the whole state, and carries exemptions for newer construction — so whether it reaches your tenancy is worth checking for your specific building.

Registration Act, 1908

Section 17(1)(d) sets the twelve-month registration line. Section 49 bars an unregistered lease that required registration from being used as evidence of the tenancy.

AP Buildings Control Act, 1960

Governs rent, eviction grounds and tenant protection in notified areas. Where it does not reach, the Transfer of Property Act, 1882 and your contract govern instead.

Model Tenancy Act, 2021

A central model law only. Tenancy is a State subject and Andhra Pradesh has not replaced the 1960 Act with its own version.

AP and Telangana still share a rate card

After the 2014 bifurcation both states retained the same stamp duty structure for leases, so the 0.4% figure applies on either side of the border. The registration offices and portals are separate — AP registers through IGRS Andhra Pradesh. Renting in Hyderabad instead? See our Telangana rent agreement page.

Drafting

Six clauses that decide the dispute

Deposit and refund window

AP deposits typically run two to three months' rent. Name the refund days and the permitted deductions.

Notice period

State it explicitly and state it both ways. Custom is not a clause.

Lock-in period

Common in Visakhapatnam and Vijayawada corporate lettings. Spell out the exit consequence.

Rent escalation

A fixed percentage on renewal beats "as mutually agreed" every time.

Maintenance split

Structural repairs versus day-to-day upkeep, and who pays apartment association dues.

Purpose of use

Residential or commercial. It changes which protections under the 1960 Act are available to you.

What you need

Four documents

  • Aadhaar — landlord and tenant
  • PAN — both parties
  • Property address and ownership reference
  • Signatures of both parties
Separate obligation

Tenant verification

Andhra Pradesh Police runs tenant verification, and city commissionerates in Visakhapatnam and Vijayawada push it actively.

It is not completed by executing the agreement, and the obligation sits with the landlord.

Avoid these

Five expensive mistakes

  • Buying a ₹100 stamp paper because a Delhi guide said so. AP charges 0.4% of total rent. On a high rent, ₹100 leaves you badly under-stamped.
  • Calculating duty on one month's rent. The base is the total rent across the whole term, not the monthly figure.
  • Adding the deposit to the calculation. AP charges on rent alone — you'd be overpaying.
  • Assuming the 1960 Act protects you. It applies to notified areas with exemptions for newer buildings. Check your specific case.
  • A vague deposit clause. See our drafting do's and don'ts.

Questions

Frequently asked

What is the stamp duty on a rent agreement in Andhra Pradesh?

0.4% of the total rent payable across the lease term, for any lease up to ten years. It is a percentage, not a flat fee — so unlike Delhi, your stamp duty rises with your rent.

Does an 11-month rent agreement need registration in Andhra Pradesh?

No. Section 17(1)(d) of the Registration Act, 1908 makes registration compulsory only for leases exceeding one year, which is why the 11-month term is standard across AP.

Is the security deposit included when calculating stamp duty?

No. Andhra Pradesh calculates duty on the total rent payable alone. The refundable security deposit stays out of the sum — a difference from states like Karnataka, where the deposit is added to the base.

Are the stamp duty rates the same in Telangana?

Yes. Both states retained the same lease stamp duty structure after the 2014 bifurcation, so 0.4% applies on either side of the border. The registration offices and portals are separate.

Who pays the stamp duty and registration charges?

No statute allocates it. In AP practice the tenant usually bears it, but the parties are free to split it — just record the arrangement in the agreement so it isn't argued later.

Can I get the agreement without visiting an office?

Yes for an 11-month agreement — we draft it, procure the stamp paper through our AP vendor network and courier it to you. Registration for longer leases does require both parties to attend the Sub-Registrar.

Stamp duty and registration figures reflect Article 31 of the Indian Stamp Act, 1899 as applicable to Andhra Pradesh, and current IGRS Andhra Pradesh practice. Rates are reviewed periodically — confirm with the Sub-Registrar on the date of execution.
