Stamp duty and registration follow the location of the property, not where you work, not where your employer is registered, and not where the broker sits. Delhi charges a flat ₹1,100 to register a lease deed however large it is. Haryana uses a slab based on transaction value that runs up to ₹50,000. On a high-value Gurugram lease, that is the line item people forget to budget for — and it dwarfs the stamp duty difference.

Stamp duty rates in Haryana

Lease duty in Haryana is a graduated structure under Article 35 of the Indian Stamp Act, 1899 as adapted by the state. Two things drive the figure: the length of the lease, and the fact that your security deposit is part of the base.

If your lease steps the rent up each year, the average annual rent used for duty must reflect all the escalated years, not the first year's figure. Corporate leases in Cyber City and Udyog Vihar almost always escalate, and this is where under-stamping quietly happens.

A Gurugram tenancy, two ways

A 2BHK at ₹25,000 a month with a ₹75,000 refundable deposit. Notice that the deposit sits inside the base — that is the step people miss.

Two deadlines you cannot miss

A document must be presented for registration within four months of execution under Section 23 of the Registration Act, 1908. Miss it and a penalty applies. Miss it by more than eight months and the Sub-Registrar will refuse the registration entirely — leaving you with a lease that cannot prove the tenancy in court.

The eleven-month rule

Why almost every Haryana tenancy is 11 months

Section 17(1)(d) of the Registration Act, 1908 makes registration compulsory for leases from year to year, or for any term exceeding one year. Eleven months keeps you inside the line — and in Haryana that saves you not just the fee but the Sub-Registrar appointment, the biometric verification and both parties having to attend in person.

Section 17(1)(d) sets the twelve-month line. Section 23 gives you four months to present the document. Section 49 bars an unregistered lease that required registration from proving the tenancy.

Haryana Urban (Control of Rent and Eviction) Act, 1973

Governs rent and eviction in urban areas of the state, including grounds on which a landlord may seek possession and protections available to the tenant.

Indian Stamp Act, 1899

Article 35 as adapted by Haryana sets the graduated lease duty. An insufficiently stamped instrument is inadmissible in evidence until the deficiency and penalty are paid.

Gurugram deposits often run two to three months. Name the refund days and permitted deductions — and remember the figure feeds your stamp duty base.

Tenant verification

Haryana Police runs tenant verification, and Gurugram and Faridabad commissionerates enforce it actively given the scale of migrant and corporate tenancy.

It is not completed by executing the agreement, and the obligation sits with the landlord.

  • Applying Delhi rates to a Gurugram property. Different state, different duty, and a registration fee slab that runs to ₹50,000 rather than a flat ₹1,100.
  • Leaving the deposit out of the base. Haryana charges on rent plus deposit. Omitting it under-stamps the document.
  • Using year-one rent on an escalating lease. The average annual rent must reflect every escalated year.
  • Missing the four-month registration window. Beyond eight months the Sub-Registrar refuses registration outright.
