A percentage — but with a ₹500 ceiling
Bihar charges 1% of the annual rent, or ₹500, whichever is lower, on agreements up to 11 months. The cap is the important half of that sentence. Once your annual rent crosses ₹50,000 — which is a little over ₹4,100 a month — the 1% calculation stops mattering and you simply pay ₹500.
Any Bihar tenancy above roughly ₹4,200 a month hits the ceiling. That makes Bihar one of the most predictable states in the country to budget for — and considerably cheaper than Karnataka or Maharashtra, where duty rises with the rent and the deposit without limit.

The base for the longer bands is the average annual rent plus the security deposit agreed in the contract — not rent alone.
Eleven months vs a two-year lease
Section 17(1)(d) of the Registration Act, 1908 makes registration compulsory for leases from year to year, or for any term exceeding one year. Bihar's jump from the capped band to the 6% band is one of the steepest in India — the same flat costs roughly twenty times more.

Based on a 2BHK in Patna at ₹12,000/month with a ₹36,000 deposit. Two-year figure: 6% of (₹1,44,000 + ₹36,000) = ₹10,800, plus ₹1,000 registration.
Because the gap is so wide, the standard practice across Patna and the rest of the state is a fresh 11-month agreement each year rather than a single longer lease. Executing two 11-month agreements costs ₹1,000 in duty; one two-year lease costs over ₹11,000.
The 1982 Act, and where it applies
Tenancies in Bihar sit under the Bihar Buildings (Lease, Rent and Eviction) Control Act, 1982, which covers fair rent, the grounds on which a landlord may seek eviction, and a tenant's protections against arbitrary rent increases. Like most rent control legislation it applies to notified urban areas rather than the whole state.
Registration Act, 1908
Section 17(1)(d) sets the twelve-month registration line. Section 49 bars an unregistered lease that required registration from being used as evidence of the tenancy.
Bihar Buildings Control Act, 1982
Governs fair rent, eviction grounds and tenant protection in notified areas. Where it does not reach, the Transfer of Property Act, 1882 and your contract govern instead.
Model Tenancy Act, 2021
A central model law only. Tenancy is a State subject and Bihar has not replaced the 1982 Act with its own version.
A notarised agreement is not a registered one. Notarisation adds a layer of authenticity and we recommend it, but it does not satisfy Section 17 where registration is legally required. Tenant verification
Bihar Police runs tenant verification, and Patna in particular pushes it given the volume of student and transient rental population.

Five expensive mistakes
- Signing a two-year lease to "save paperwork". It costs roughly twenty times more in duty. Two 11-month agreements are far cheaper.
- Buying a ₹100 stamp paper by habit. That's the Delhi rate. Bihar charges 1% of annual rent up to a ₹500 cap.
- Forgetting the deposit in the longer bands. Above 11 months, duty is charged on rent plus deposit.
- Treating notarisation as registration. They are different things and only one satisfies Section 17.
