Case: – “Sunny” The Only Legal Heir of the DDA Freehold Property wants to transfer/change the title of the Property in his name which was owned by his deceased Father.What will be the Procedure to do that if his father dies intestate i.e. without WILL?
Answer: – Sunny has to visit to the court to apply for the “Succession Certificate” in favor of his name.
Case: – Ram Prakash dies and has not left the WILL and left behind his son namely-Rajesh, his two Daughters and his Wife. Now, Rajesh the son of Late Ram Prakash wants to transfer/change the title of the Leasehold Property of DDA in his name which was owned by his deceased father (Late Ram Prakash). What will be the Procedure?
Answer: – Late Ram Prakash’s wife and his two Daughters have to register a Relinquishment Deed in the Sub-Registrar office in favor of Rajesh (son of Late Ram Prakash). Then furthermore, Rajesh can apply in DDA for Mutation and Freehold of the said property.
Case: – DDA allotted a flat to Mohan Gupta in 1972 and Mohan Gupta died in 1975 without leaving WILL. Mohan Gupta’s son Ravinder Gupta mutated the ownership of said DDA flat in his name in 1976. In 1991, Ravinder Gupta also died without leaving WILL and now his elder son Satish Gupta wants to transfer/change the title of DDA flat in his name. How can he do that?
Answer: – All the Legal Heirs of Ravinder Gupta have to register the Relinquishment Deed in the name of Satish Gupta and finally Satish Gupta can apply for freehold conversion for getting the final rights of ownership.
Case: – Pratap owns the Society Flat and He is the original allottee of the flat. Now Pratap wants to transfer his ownership to his real sister namely Sushma. What will be the Procedure?
Answer: – According to the DDA policy, there is a Procedure named “Transfer in Blood Relation for Life Time”. Pratap and Sushma needs to apply to the mentioned procedure.
Case: – Banwari Lal owns the DDA Residential Plot of 160sqmtr. and he Constructed three floors- Ground Floor, First Floor, Second Floor and one Roof and after getting his residential plot Freehold from DDA he wrote the WILL in favor of his three son namely Raj, Mukesh and Sameer. Banwari Lal dies and as per Banwari Lal’s WILL- Now, Raj is the owner of Ground Floor, Mukesh is the owner of Second Floor and Sameer is the owner of Third Floor and the rights of the Roof is Common among them. Than, Raj (Banwari Lal’s elder son) dies intestate i.e. without WILL and left behind his Wife, One Daughter and One Son. How his Wife will be the owner of the Floor which Raj got as per his Father’s WILL?
Answer: – Raj’s Daughter and his Son have to register the Relinquishment Deed in Sub-Registrar office in the name of their Mother. Then she will be the legally owner of his deceased Husband’s Floor.
Case: – Amit owns the DDA Flat and He is the original allottee of the flat. Now Amit wants to add his wife as a co-owner in his property. What will be the Procedure?
Answer: – According to the DDA policy, there is a Procedure named “Inclusion of Name”. Amit needs to apply to the mentioned procedure to make his wife a co-owner in his property.
Case: – My name is Suresh and my Deceased Father purchased the DDA Flat through General Power of Attorney. General Power of Attorney is on my mother’s name and Agreement to sell on my deceased father’s name. My father died without leaving WILL. Now, how will my mother can be the owner of the mentioned property?
Answer: – Suresh have to register the Relinquishment Deed in the Sub-Registrar office in favor of his mother and then his mother can apply for conversion of property into Freehold in DDA Office. As per DDA policy, In GPA’s Death case of without WILL DDA does not issue mutation letter instead of Mutation Letter DDA directly freehold the property. This procedure is known as”Subsitution”.
