Service Name: Zapp Legal Notice
1. Nature of Service
Zapp is an automated legal notice drafting platform operated by Edrafter Legal Solutions Pvt. Ltd.
The legal notice draft is generated through an automated system based solely on the information submitted by the user.
The templates used are designed under the supervision of experienced advocates.
The service includes advocate review, verification of uploaded documents, and affixation of seal & signature upon approval.
Zapp does not constitute full legal representation unless separately agreed.
2. Platform Facilitation Disclaimer
Zapp is a technology-enabled platform operated by eDrafter Legal Solutions Pvt. Ltd. for facilitating the preparation, review, and issuance of legal notices through independent Advocates.
Neither Zapp nor eDrafter independently practice law, appear before Courts, provide legal representation, or act as legal counsel to any User. Any legal notice issued through the Platform is reviewed, approved, and issued by the concerned independent Advocate exercising their own professional judgment.
3. User Responsibility & Declaration
By submitting the form, you confirm that:
- All information provided is true, correct, and complete.
- All uploaded documents are genuine and lawfully obtained.
- The claim is not false, malicious, defamatory, or fabricated.
- The dispute is lawful and suitable for issuance of a legal notice.
The User agrees that any misrepresentation shall make them solely liable for all civil or criminal consequences.
4. User-Authorized Content
The User expressly authorizes the concerned Advocate to issue the legal notice based solely upon the information, statements, allegations, facts, documents, and instructions submitted by the User.
The User acknowledges that neither Zapp, eDrafter, nor the concerned Advocate independently verifies every factual assertion submitted by the User and the notice is issued based upon the User's representations and instructions.
5. Advocate Review & Approval Rights
After payment:
- The assigned advocate shall review the draft and uploaded documents.
- The advocate may:
- Approve and seal/stamp the notice, OR
- Seek clarification/documents, OR
- Reject the notice if the case lacks merit, appears false or defamatory, documentation is insufficient, matter is criminal in nature, involves complex litigation beyond Zapp scope.
The advocate’s decision shall be final and binding.
6. Advocate Professional Discretion
The concerned Advocate shall have complete professional discretion to modify, revise, remove, reject, refuse, or decline any statement, allegation, claim, demand, paragraph, relief, or content proposed by the User if such content is considered unsupported, defamatory, unlawful, misleading, unethical, professionally inappropriate, or contrary to applicable law or professional obligations.
The User shall not have any right to compel an Advocate to include any particular statement, allegation, demand, or claim within the legal notice.
7. No Legal Opinion or Case Assessment
The issuance, review, approval, or signing of a legal notice through Zapp shall not be construed as a legal opinion regarding the merits, strength, validity, maintainability, or likelihood of success of the User's claim.
Approval of a legal notice by an Advocate shall not imply that the claim is legally sustainable or that the User shall succeed in any future proceedings.
8. Refund Policy
Refund shall be applicable only if the advocate formally rejects the notice after review.
No refund shall be provided if incorrect opponent details are submitted, the user changes their mind after review has started, or the notice is already sealed and issued.
Refund processing time: 5–7 working days.
9. Scope Limitation
Zapp service is intended for low-value or straightforward disputes such as money recovery, employment dues, consumer complaints, and basic contractual defaults.
Zapp does NOT include court representation, follow-ups, negotiation services, litigation filing, ongoing advisory, criminal complaints, or defamation escalation handling.
Any additional service shall be chargeable separately.
10. Pre-Litigation Communication Only
The User acknowledges that Zapp is intended solely as a pre-litigation communication platform.
The issuance of a legal notice shall not amount to initiation of legal proceedings and shall not create any obligation upon Zapp, eDrafter, or the concerned Advocate to institute, prosecute, defend, manage, or pursue any future legal proceedings unless separately engaged.
11. No Follow-Up Obligation
The advocate shall issue the notice but shall not engage in follow-ups, calls (if not opted), negotiations, or settlement discussions unless separately engaged.
12. No Recovery, Collection or Enforcement Services
Zapp, eDrafter, and associated Advocates do not function as debt collection agencies, recovery agents, recovery teams, collection agencies, enforcement agencies, investigation agencies, or similar entities.
Any legal notice issued through the Platform shall be treated solely as a legal communication and shall not be construed as a recovery action, coercive measure, collection proceeding, enforcement activity, or investigation.
13. Delivery of Notice
The notice may be delivered through Email, WhatsApp (if opted), or Courier (if opted and paid separately).
Delivery confirmation does not guarantee response from the opposite party.
Note: If you do not select the courier option while creating your Zapp Legal Notice, you can still choose it within the next 10 days. After this period, the notice record will be automatically destroyed and courier dispatch will no longer be available.
14. Service of Notice Disclaimers
Delivery, dispatch, transmission, or service of a notice through Email, WhatsApp, Courier, Registered Post, Speed Post, or any other mode does not guarantee that the Opposite Party has read, acknowledged, accepted, responded to, acted upon, or complied with the notice.
15. No Guarantee Clause
eDrafter and its advocates do not guarantee payment recovery, settlement, legal success, court outcome, or response from the opposite party.
Zapp is a notice issuance service, not a recovery or enforcement service.
16. Notice Period Disclaimer
The User acknowledges that issuance of a legal notice does not legally compel the Opposite Party to respond, settle, negotiate, make payment, comply with the demands, or otherwise act upon the contents of the notice.
The Opposite Party shall remain free to dispute, reject, ignore, contest, or deny the allegations and demands raised in the notice.
17. Limitation of Liability
Under no circumstances shall eDrafter, Zapp, or its advocates be liable for indirect damages, loss of reputation, business loss, or litigation costs arising from user-submitted content.
Maximum liability shall be limited to the amount paid for the Zapp service.
18. Indemnity Clause
The User agrees to indemnify and hold harmless Edrafter Legal Solutions Pvt. Ltd., Zapp platform, and assigned Advocate(s) against any claim, loss, penalty, defamation action, or legal proceeding arising from false statements, forged documents, misleading information, or malicious intent.
19. Protection Against Opposite Party Claims
In the event any complaint, legal proceeding, defamation action, criminal complaint, regulatory complaint, consumer dispute, Bar Council complaint, or other claim is initiated by the Opposite Party arising from the contents of the legal notice, the User shall remain solely responsible for defending and resolving such proceedings.
The User shall indemnify and keep indemnified Zapp, eDrafter, the concerned Advocate, employees, representatives, and service providers against all such claims, proceedings, liabilities, costs, and expenses.
20. Confidentiality
All information submitted shall be treated as confidential, subject to legal compliance requirements.
21. Advocate-Client Relationship
The limited review under Zapp does not create a full attorney-client relationship beyond issuance of the notice unless separately engaged.
22. Independent Advocate Status
The User acknowledges that the Advocate reviewing, approving, or issuing the legal notice acts in an independent professional capacity and exercises independent legal judgment.
Nothing contained on the Platform shall be construed as creating an employer-employee relationship, principal-agent relationship, partnership, joint venture, legal partnership, profit-sharing arrangement, or professional association between Zapp/eDrafter and the concerned Advocate.
23. Professional Compliance Statement
The User acknowledges that Advocates associated with the Platform remain independent legal professionals governed by their respective professional obligations and applicable laws.
Nothing contained on the Platform shall be construed as solicitation of legal work by an Advocate, guarantee of legal outcome, or any arrangement prohibited under applicable law.
24. Governing Law & Jurisdiction
This service shall be governed by the laws of India. Exclusive jurisdiction: Courts at Noida, Uttar Pradesh.
25. Automated Draft Disclaimer
The user acknowledges that the draft is system-generated, not manually customized unless separately opted, and minor drafting variations may occur due to system processing.
26. User Misuse of Notice
The User shall not alter, edit, manipulate, fabricate, partially reproduce, modify, misrepresent, circulate, publish, or use any Advocate-issued legal notice in a misleading or unauthorized manner.
Any such alteration, misuse, misrepresentation, or unauthorized use shall be solely attributable to the User and neither Zapp, eDrafter, nor the concerned Advocate shall bear any responsibility arising therefrom.
27. Advocate Substitution Rights
Zapp and eDrafter reserve the right to replace, reassign, or substitute the concerned Advocate at any stage prior to issuance of the legal notice due to unavailability, conflict of interest, operational requirements, regulatory considerations, professional reasons, or any other reasonable cause.
Such substitution shall not entitle the User to any refund, compensation, or claim.
